Pro-Demnity Insurance Company



Pro-Demnity Insurance Company (successor of the Indemnity Plan 1987-2002), a wholly-owned subsidiary of the Ontario Association of Architects, provides mandatory professional liability insurance coverage to Ontario architectural practices in accordance with the Architects Act and its regulations.

Reinsurance arranged through Lloyd’s of London in 1999 enabled Pro-Demnity to increase the limits of liability available to Ontario practices, up to $5,000,000 each claim above the mandatory limit of $250,000, for both annual practice and single project insurances. The increased limits program provides broader coverage, with the prime benefit of the reporting and handling of claims being by one source only, making for a seamless coverage, avoiding the variations in coverage that existed with the primary and excess insurance relationships.

An ANNOUNCEMENT has recently been sent out to Pro-Demnity policyholders of a special insurance arrangement for large single projects (multi-year; up to $5 million each claim) through an exclusive insurance broker.

Professional Liability Insurance
All architects, with a Certificate of Practice, are legally required to have professional liability insurance. The following insurances outlined below are available:
  • Annual Practice Insurance
  • Single Project Insurance
  • Retirement from Practice
  • Mold Fund
  • Increased Limits of Liability

Annual Practice Insurance
This provides the mandatory indemnification required by the Architects Act and its regulations.

Limits of Liability:
Claim Limit $250,000
Project Limit $500,000
Aggregate Limit $1,000,000

(Note: The Project Limit represents the maximum amount the insurer will pay as damages for a project arising from al claims reported during the Period of Insurance subject to the Claim Limit and Aggregate Limit.) Single Project Insurance
This supplements the mandatory indemnification requirement through the issuance of single project insurance when required by the holder or client. While it is in force, the single project insurance replaces the annual practice insurance.

Limits of Liability:

Claim Limit $250,000
Aggregate Limit $500,000 Retirement From Practice Insurance
This is applicable to OAA members that meet the eligibility requirements of the OAA Council. The requirements are participation in the Indemnity Plan or being insured by Pro-Demnity Insurance Company for two years, and payment of premiums, levy, deductible and taxes.

The procedure is for eligible members to be automatically covered on the Expiration Date of their annual practice insurance following the date of surrender of Certificate of Practice.
Mold Fund
The purpose of this Fund is to provide protection against damages and supplementary payments that would have been payable in the absence of the Mold Exclusion of the Policies Nos. 1, 2, 3, and 4.

Maximum Amounts Payable:
Fund Limit $3,000,000 or such lesser amount that remains in the Fund
Increased Limits of Liability Program
This provides both the mandatory indemnification required by the Architects Act and its regulations and additional limits of liability requested by the holder.
Non-Drained Exterior Wall Exclusion & Window Wall Endorsements
Applicable to designs commencing on or after January 1, 2010.
