Being the "Consultant" under Ontario's Revised Construction Act

Session Abstract:

Lots of information is being shared about the latest changes to the Construction Act.  This presentation will cover the PRACTICAL implications of the 2018 AND 2024 changes from the perspective of a payment certifier/owner's advisor.  We will look at this in the context of both a traditional project and a construction management project structure.

Learning Objectives:

  1. Being able to implement the new prompt payment regime on projects
  2. Being able to implement the new annual release of holdback on projects
  3. Being able to identify gaps in the legislation and use best practice when confronted with a situation where the Act is unclear or silent
  4. Understanding how to advise the owner if issues arise on a project, and when to seek legal advice

 

About the Speakers:

 Paige Crewson, Counsel, Kennaley Construction Law

Paige Crewson is a construction lawyer with over twenty years' experience and an undergraduate degree in architecture and building science.  She has lived and worked in Canada, the United Kingdom and the United Arab Emirates, and has advised on major projects and disputes around the globe, often in the context of public private partnerships and other project-finance structures. With both a technical and legal understanding of the issues that arise in construction, Paige can communicate difficult concepts using readily understood language and illustrative examples. She is able to help participants place legal concepts into the reality of their daily work. 


Joe O'Hearn, Associate Lawyer, Kennaley Construction Law

Joe is an Associate Lawyer at Kennaley Construction Law practicing exclusively in the area of construction law. Joe works with a variety of clients, in both the public and private sectors, ranging from owners, contractors, subcontractors and all manner of design professionals and consultants, including architects and engineers.

Joe’s practice involves asserting and defending various construction-related claims and resolving any construction-related disputes. Joe has experience litigating matters throughout the Province of Ontario and has appeared before the Ontario Superior Court of Justice and its Divisional Court, and the Court of Appeal for Ontario. Joe has alternative dispute resolution experience such as advocating for clients in mediations, arbitrations, and adjudications under Ontario’s Construction Act. Joe’s practice extends beyond litigation as he advises his clients on contracts, and the drafting and negotiating of same. Joe also writes for his firm’s blog and gives presentations for various webinars and conferences.

Joe completed law school at the University of Leicester in the United Kingdom and his undergraduate studies at Queen’s University in Kingston, ON. Prior to joining Kennaley Construction Law, Joe summered with a leading plaintiff-side personal injury firm in Toronto, ON. When he is not spending time with his family and friends, Joe can be found on the golf course in the summer (or somewhere warm in the winter months) and playing men’s league hockey in the winter.


Rachel Prestayko, Associate Lawyer, Kennaley Construction Law

Rachel Prestayko is an Associate Lawyer at Kennaley Construction Law practicing exclusively in the area of construction law. Rachel works with a variety of clients, ranging from owners, contractors, subcontractors and all manner of design professionals and consultants, including architects and engineers.

Rachel has represented corporations and individuals in all types of construction disputes, and, in addition to traditional lien and litigation claims, is experienced with adjudications under the Construction Act and alternative dispute resolution mechanisms including negotiation, arbitration, and mediation.

Rachel previously worked at leading multinational and regional law firms, focusing on commercial litigation. Prior to law, Rachel worked as a Research Associate in the tech sphere, is a published co-author in the journal Nanotechnology a co-inventor on five registered patents.  She earned her law degree from the University of Ottawa and B.Sc. in Honours Chemistry from McMaster. Rachel is a member of a number of construction and law associations, is an avid curler and enjoys the latest issue of the Walrus when not spending time with friends and family.
